California Privacy Notice (CCPA/CPRA)

This California Privacy Notice supplements our Privacy Policy and applies to California residents (“consumers”) under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA/CPRA”).

1. Who this applies to

It applies to California residents whose personal information we process as a business. Where we process information on behalf of a client, we act as that client’s service provider and handle the information only under our contract with them.

2. Categories of information we collect

In the preceding twelve months we may have collected the following categories of personal information, as described in our Privacy Policy: identifiers (such as name, email, company); commercial information (such as services purchased and billing records); internet or network activity (such as pages visited and device/browser data collected via cookies); geolocation (approximate, from IP address); and the contents of communications you send us. We collect this information from you directly, automatically through your use of our sites, and from clients who direct us to process data.

3. Sale and sharing of personal information

CloviTek AI does not sell your personal information for money, and does not “share” it for cross-context behavioural advertising as those terms are defined under the CPRA. We do not have actual knowledge of selling or sharing the personal information of consumers under 16 years of age.

4. Your California rights

Subject to the CCPA/CPRA, you have the right to:

• Know / access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties to whom it is disclosed;
• Delete personal information we have collected from you, subject to exceptions;
• Correct inaccurate personal information;
• Opt out of any sale or sharing of personal information (we do not sell or share, so no action is required, but you may still submit a request);
• Limit the use of sensitive personal information;
• Non-discrimination for exercising your rights.

5. How to exercise your rights

To submit a request, email [email protected] with the subject “California privacy request”. We verify your identity before responding and aim to respond within the timeframes required by law (generally 45 days, extendable). We will not charge a fee for a verifiable request unless it is excessive or repetitive.

6. Sensitive personal information

We do not use or disclose sensitive personal information for purposes other than those permitted under the CPRA (such as providing the Services you request, security, and legal compliance), and therefore the right to limit its use does not change how we operate.

7. No discrimination

We will not deny you goods or services, charge different prices, or provide a different level of service because you exercised your CCPA/CPRA rights.

8. Authorized agents

You may use an authorised agent to submit a request. We may require the agent to provide proof of authorisation and may ask you to verify your identity directly.
