Acceptable Use Policy

This Acceptable Use Policy (the “Policy”) governs your use of CloviTek AI LLC’s websites, platforms, applications, and services (the “Services”). It supplements, and is incorporated into, our Terms of Service. By using the Services you agree to this Policy.

1. Scope

This Policy applies to everyone who accesses or uses the Services, including account holders, their end users, and visitors. You are responsible for use of the Services under your account and for ensuring your end users comply with this Policy.

2. Acceptable use

You may use the Services only for lawful business purposes, in accordance with your agreement with us, this Policy, and all applicable laws and regulations. You must have all rights and permissions necessary for any content and data you submit to the Services.

3. Prohibited activities

You must not use the Services to:

• violate any law, regulation, or third-party right, including intellectual-property, privacy, publicity, or contractual rights;
• upload, generate, or distribute content that is unlawful, defamatory, harassing, hateful, threatening, sexually exploitative of minors, or that incites violence;
• transmit malware, ransomware, or any code intended to disrupt, damage, or gain unauthorised access to systems or data;
• send unsolicited bulk messages (spam), phishing, or other deceptive communications, or violate anti-spam laws such as CAN-SPAM, CASL, or GDPR/PECR;
• impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• attempt to gain unauthorised access to, probe, scan, or test the vulnerability of any system or network, or breach any security or authentication measure;
• interfere with or disrupt the integrity or performance of the Services, including through excessive automated requests, denial-of-service activity, or circumventing rate limits or usage quotas;
• reverse engineer, scrape, or resell the Services except to the extent this restriction is prohibited by law;
• use the Services to build a competing product, or to train third-party models on our proprietary outputs in breach of your agreement with us;
• process the personal data of others without a lawful basis and appropriate notice and consent.

4. AI-specific rules

Where the Services include AI generation, review, or automation, you must not use them to produce or distribute disinformation presented as fact, to generate content that impersonates a real individual in a deceptive manner, to make consequential decisions about individuals without appropriate human oversight, or to generate material that infringes third-party rights. You remain responsible for reviewing AI-assisted output before relying on or publishing it.

5. Security and integrity

You must keep your credentials confidential, use the Services in a manner that does not compromise their security, and promptly notify us of any suspected unauthorised access or security incident affecting your account. We operate technical controls described in our Security Statement.

6. Outreach and third-party data

If you use features that enrich, contact, or process third-party (prospect or lead) data, you are the controller of that data and are responsible for having a lawful basis, honouring opt-out and suppression requests, and complying with applicable marketing, privacy, and anti-spam laws. Our handling of such data is described in our Privacy Policy.

7. Enforcement

We may investigate suspected violations and may suspend or terminate access, remove or disable content, or take other action we consider appropriate, including reporting activity to law enforcement. Where practical and lawful, we will give notice; for serious or ongoing violations we may act immediately. Termination for a breach of this Policy is governed by our Terms of Service.
